Smart Mortgage Solutions LLC ("Smart Mortgage," "we," "our," or "us") respects your privacy. This Online Privacy Policy describes how we collect, use, share, and protect personal information when you visit smartmtg.com (the "Site"), use our online tools (including the mortgage calculator and partner intake forms), or otherwise interact with us online. It supplements — and does not replace — the Gramm-Leach-Bliley Act ("GLBA") Privacy Notice we provide to mortgage applicants and borrowers in connection with a loan application or loan account.

1. Information We Collect

We collect personal information about visitors and prospective borrowers in the following ways:

  • Information you provide. When you submit a contact, consultation, agent partner, or loan officer interest form, request a pre-approval, or contact us by phone or email, you may provide your name, address, email, phone number, employer, occupation, citizenship status, marital status, date of birth, Social Security number, government-issued identification, financial information (income, assets, debts), employment history, credit information, property information, and any other information you choose to share.
  • Information from third parties. With your authorization, we receive information about you from consumer reporting agencies (credit reports and scores), employers (verifications of employment and income), banks and asset custodians (verifications of deposit), title companies, appraisers, real estate agents, insurance carriers, and government records.
  • Information collected automatically. When you use the Site, our servers and analytics tools may automatically collect device, browser, and connection information (IP address, user-agent, referring URL, pages viewed, time stamps, approximate location), and information collected via cookies and similar technologies (see Section 7).

2. How We Use Personal Information

We use personal information to: respond to your inquiries; evaluate, originate, process, underwrite, fund, and service mortgage loans; verify your identity and prevent fraud; comply with applicable federal and state laws (including the Real Estate Settlement Procedures Act, the Truth in Lending Act, the Equal Credit Opportunity Act, the Bank Secrecy Act, the Home Mortgage Disclosure Act, and the SAFE Act); maintain the security and integrity of our systems; analyze and improve our website, products, and services; and communicate with you about our services. We do not sell personal information.

3. How We Share Personal Information

We share personal information only as permitted or required by law and only to the extent necessary to deliver the services you request or to comply with our legal obligations. Categories of recipients may include:

  • Service providers and vendors that support our operations — including loan origination system providers, credit-reporting agencies, verification services, document storage and e-signature platforms, customer relationship management systems, hosting and analytics providers, automation platforms (e.g., Zapier), and email service providers — subject to confidentiality obligations.
  • Loan investors, secondary-market participants, mortgage insurers, warehouse lenders, sub-servicers, and successor servicers in connection with the origination, sale, or servicing of your loan.
  • Settlement and transaction participants such as title insurers, escrow agents, real estate agents, appraisers, surveyors, hazard and flood insurers, and HOA/condo associations involved in your transaction.
  • Government agencies, regulators, and law enforcement as required by applicable law, subpoena, court order, or in response to a lawful request.
  • Affiliates and successors in the event of a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction.

4. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. These safeguards include access controls, encryption in transit, secure document portals, vendor due diligence, and employee training. No method of transmission over the internet or storage is 100% secure, however, and we cannot guarantee absolute security.

5. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal, accounting, and regulatory obligations (including federal and state mortgage record-retention requirements), to resolve disputes, and to enforce our agreements.

6. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can delete it.

7. Cookies, Analytics, and Online Advertising

We use cookies, pixels, and similar technologies to operate the Site, remember your preferences, measure and analyze traffic, and improve the user experience. You can manage cookies through your browser settings; disabling cookies may affect Site functionality. We may use third-party analytics providers and embedded social-proof or review widgets that collect information about your interactions with the Site under their own privacy practices. We do not respond to "Do Not Track" browser signals at this time.

The Site may link to third-party websites and services (for example, online application portals, NMLS Consumer Access, or social media). We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy notices before providing personal information.

You may contact us at any time to: request access to or correction of personal information you have provided; request that we stop contacting you for marketing purposes; or unsubscribe from marketing emails by following the unsubscribe link in those emails. Depending on where you reside, you may have additional rights under state law (such as the right to know, delete, or correct personal information). To exercise any rights, contact us using the details in Section 13 and we will respond as required by applicable law.

10. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), provides you with additional rights regarding personal information we collect, including the right to:

  • Know the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it.
  • Delete personal information we have collected from you, subject to legal and regulatory exceptions (including federal mortgage record-retention requirements).
  • Correct inaccurate personal information we maintain about you.
  • Limit the use and disclosure of sensitive personal information to purposes specified in the CCPA/CPRA.
  • Opt out of sale or sharing of personal information. We do not sell personal information and we do not share personal information for cross-context behavioral advertising as those terms are defined under the CCPA/CPRA.
  • Non-discrimination for exercising any of the above rights.

Personal information collected, processed, or disclosed in connection with a mortgage loan transaction subject to the federal Gramm-Leach-Bliley Act and its implementing Regulation P is generally exempt from the CCPA/CPRA. To submit a request, contact us using the details in Section 13. We will verify your identity before responding and may require additional information to do so. You may also designate an authorized agent to make a request on your behalf, subject to verification.

11. SMS / Text Message Communications

If you provide your mobile phone number, you consent to receive transactional and account-related calls and text messages from us at that number, including by automated dialing technology, regarding your inquiry or loan. Message and data rates may apply. You may opt out of marketing texts at any time by replying STOP; standard transactional messages related to a pending loan may continue as required by law.

12. Changes to This Policy

We may update this Online Privacy Policy from time to time. The "Effective Date" and "Last Updated" dates at the top reflect the most recent revision. Continued use of the Site after the effective date of an update constitutes acceptance of the updated policy.
